Nach uns vorliegenden Unterlagen fordern US-amerikanische Unternehmen ihre deutschen Geschäftspartner auf, ein Formular W-8BEN-E vorzulegen. Kann das Formular nicht vorgelegt werden, müssen die amerikanischen Unternehmen eine 30-prozentige Quellensteuer einbehalten. Es wird auch befürchtet, dass möglicherweise Geschäfte nicht zustande kommen. Die US-amerikanische Finanzbehörden wollen damit klären, ob es sich bei dem Zahlungsempfänger um eine in den USA steuerpflichtige Person handelt.

Unser Kooperationspartner Greenback Tax Services hat uns hierzu folgendes mitgeteilt:

Form W-8BEN-E is used to determine if withholdings are required from US earnings paid to a foreign entity. Most private foreign companies, trusts, partnerships, etc will be considered Non-Financial Foreign Entities (NFFE) which means they are not banks or brokerages. As an NFFE you can then either be “active” or “passive”, a passive NFFE would be one that earns income through non-active means, such as investments, this type of entity may also be considered a PFIC.

The form itself is very easy to fill out. If your company is an Active NFFE you fill out page 1 of the form W-8BEN-E, In Section 5 you would choose your entity type, Active and Passive NFFE are located in the second column #’s 4 & 5 from the bottom. After filling out page one you would then fill out the Part that relates to the type of entity you have elected in Part 5, i.e. Part XXV for an Active NFFE.
